These Terms of Service ("Terms") govern your access to and use of the Cascade website, application, AI agents, and related services (collectively, the "Service") provided by Imaginasium LLC, a Wyoming limited liability company ("Cascade," "we," "us," or "our"). By accessing or using the Service — including by interacting with a Cascade AI agent, sending or receiving SMS messages from a Cascade number, or creating an account — you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. You agree to notify us promptly at support@startcascade.ai if you believe your account has been compromised.

2. Nature of the Service

Cascade is an AI-powered business operations platform. The Service provides you with AI agents that assist with business operations, communications, and decision support.

You understand and agree that:

  • Cascade agents are artificial intelligence systems, not humans. All agent communications are AI-generated.
  • AI-generated outputs — including business recommendations, operational suggestions, drafted communications, and analytical reports — are provided for informational and assistive purposes. They may contain errors, omissions, or inaccuracies.
  • You are responsible for independently verifying AI-generated information before relying on it for significant business, financial, legal, or operational decisions.
  • Cascade does not provide legal, financial, medical, or other professional advice. AI agent outputs should not be treated as a substitute for qualified professional counsel.

3. Acceptable Use

You agree not to:

  • Use the Service in violation of any law, regulation, or third-party right, including intellectual property and privacy rights.
  • Send unlawful, harassing, deceptive, or unsolicited commercial messages through the Service.
  • Attempt to probe, scan, disrupt, or gain unauthorized access to the Service, related systems, or other users' accounts.
  • Reverse engineer, decompile, scrape, or resell the Service except as expressly permitted.
  • Use the Service to develop competing AI products by systematically extracting agent behavior patterns or prompts.
  • Provide false identity information or impersonate another person or business.
  • Use the Service in any manner that could damage, disable, or impair its operation.

We may suspend or terminate access for any violation of these terms, with or without notice.

4. SMS Messaging Terms

The Service includes SMS text messaging. The following apply whenever you opt in to or exchange SMS messages with Cascade:

  • You consent to receive SMS messages from Cascade by (a) providing verbal consent during an inbound phone call or (b) checking a consent checkbox on a Cascade web form. Consent is not a condition of any purchase.
  • Message and data rates may apply. Message frequency varies based on your interactions with the Service.
  • Opt out at any time: reply STOP to any Cascade SMS to unsubscribe. After you send STOP, we will send a single confirmation message and will not send further SMS until you opt in again.
  • Support: reply HELP to any Cascade SMS or email support@startcascade.ai for assistance.
  • Carriers are not liable for delayed or undelivered messages.
  • Your phone number and SMS opt-in information are handled as described in our Privacy Policy and are never sold or shared with third parties for marketing.

5. Your Content and Data

You retain ownership of all content and data you submit to the Service ("Your Content"). You grant us a limited, non-exclusive, worldwide, royalty-free license to process, store, and display Your Content solely as necessary to operate and provide the Service to you. This license terminates when you delete Your Content or close your account, except as necessary for backup, compliance, or legal obligations.

We do not use Your Content to train AI models. Your conversations and business data are processed solely to deliver the Service.

6. Intellectual Property

The Service, including its software, AI agents, designs, documentation, and content (excluding Your Content), is owned by Imaginasium LLC and its licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. This license does not include the right to sublicense, modify, or create derivative works of the Service.

7. Copyright Infringement (DMCA)

If you believe content available through the Service infringes your copyright, please send a notice to our designated agent:

Your notice must include: (a) a description of the copyrighted work, (b) identification of the infringing material and its location, (c) your contact information, (d) a statement of good-faith belief that the use is unauthorized, and (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY MESSAGES WILL BE DELIVERED WITHIN A SPECIFIC TIME.

AI-SPECIFIC DISCLAIMER: AI-GENERATED OUTPUTS, INCLUDING BUSINESS RECOMMENDATIONS, OPERATIONAL SUGGESTIONS, AGENT COMMUNICATIONS, AND ANALYTICAL REPORTS, ARE PROVIDED FOR INFORMATIONAL AND ASSISTIVE PURPOSES ONLY. THEY MAY CONTAIN ERRORS, OMISSIONS, OR INACCURACIES. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED OUTPUT. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR RELIANCE ON AI-GENERATED INFORMATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL IMAGINASIUM LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR RELIANCE ON AI-GENERATED OUTPUTS. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to indemnify, defend, and hold harmless Imaginasium LLC, its officers, members, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms, (b) Your Content, (c) your reliance on or use of AI-generated outputs in a manner inconsistent with the disclaimers in these Terms, or (d) your violation of any law or third-party right.

11. Dispute Resolution

Informal Resolution First

Before filing any formal dispute, you agree to contact us at support@startcascade.ai and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, either party may elect to resolve it through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in Wyoming or, at your election, by phone or video. Each party bears its own costs; AAA fees are governed by AAA rules.

Class Action Waiver

YOU AND IMAGINASIUM LLC EACH WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS.

Small Claims Exception

Either party may bring a qualifying claim in small claims court (claims under $10,000) in the claimant's county of residence or in Wyoming.

30-Day Opt-Out

You may opt out of this arbitration provision by sending written notice to support@startcascade.ai within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if we reasonably believe your use poses a risk to the Service or other users, or if required by law. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and notify you of material changes through the Service or by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. General

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Imaginasium LLC regarding the Service.
  • Severability. If any provision is found unenforceable, the remaining provisions continue in effect.
  • Waiver. Our failure to enforce any provision is not a waiver of that provision.
  • Assignment. You may not assign these Terms without our written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
